Terms and Conditions of Advertising
1. Pocket Saver Guide Ltd is a company registered in England
and Wales number 7262821 and its address at which documents may be served
is PO Box 414141, 4 Victoria Street, Glossop, Derbyshire SK13 6WR.
2. These Conditions shall be deemed to be incorporated in all contracts
of Pocket Saver Guide Ltd to sell goods or services and in the case
of any inconsistency with any order or form of contract sent by
the purchaser
to Pocket Saver Guide Ltd whatever may be their respective dates
the provision of these Conditions shall prevail unless expressly
varied
in writing and signed by a director of Pocket Saver Guide Ltd.
3. A booking may be cancelled at any time before the deadline by
Pocket Saver Guide Ltd or the customer giving written notice
to that effect.
Pocket Saver Guide Ltd reserves the right to charge a cancellation
fee where work has already been carried out on a booking at the
time of cancellation.
4. Any explicit and determined dates given for completion or
delivery of each edition of the publication shall be binding
on Pocket Saver
Guide Ltd. Such liability shall not extend to delays beyond
the control of
Pocket Saver Guide Ltd including, without prejudice to the
generality of the foregoing, omission of information, delays in approval
of proofs, and non-performance of carriers.
5. By its nature this booking does not have a redeemable value
and no refunds or credits will be entertained once a booking
has been
made.
6. Proofs must be signed and returned by the deadline date
shown on the proof. Where a customer fails to return the
proof by the
deadline date,
Pocket Saver Guide Ltd will print the most recent proof
it has produced whether or not it has been approved for publication.
No refund or
consideration
will be entertained under this clause for any loss or damage
incurred by the publication by Pocket Saver Guide Ltd of
an unapproved
advertisement.
7. Pocket Saver Guide Ltd shall not be liable for any costs,
claims or damage arising out of any act of tort or omission
or breach of
contract or statutory duty calculated by reference to
profits, income production
or accruals or loss of such profits, income production
or accruals or
by reference to accrual of such claim, damages or expenses
on a time basis.
8. The liability of Pocket Saver Guide Ltd to the advertiser
for any loss or damage of whatever nature and however
caused shall be
limited
to the value of the booking.
9. No statement, description, information, warranty
or recommendation contained in any catalogue, price
list,
advertisement, website
or communication, or made verbally by any agent of
Pocket Saver Guide
Ltd, shall be construed
to enlarge, vary or override in any way these Conditions.
10. Any concessions made or latitude allowed by Pocket
Saver Guide Ltd to the purchaser shall not affect
the strict rights
of Pocket
Saver Guide
Ltd under the contract. If in any particular case
any of these Conditions shall be held to be invalid
or
shall not
apply to
the contract the
other Conditions shall continue in full force and
effect.
11. At its sole discretion Pocket Saver Guide Ltd
reserves the right to decline to any advertisement
or content
it deems to
be inappropriate.
Any payments made for work rejected by reason
of this clause will be refunded in full.
12. Nothing herein shall have the effect of excluding
or restricting the liability of Pocket Saver
Guide Ltd for
death or personal
injury resulting from its negligence insofar
as the same is prohibited by
statute, or under sections 12, 13, 14 and 15
of the Sale of Goods Act 1979 to
a purchaser who is dealing with a customer
as defined by section 12 of the Unfair Contract
Terms Act
1977.
13. The contract shall in all respects be governed
by English law and shall be deemed to have
been made in
